§1 Applicability to Consumers and Definitions

(1) These Terms and Conditions apply to all deliveries between us and a consumer in their version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity (§ 13 BGB).

§2 Conclusion of Contract, Storage of Contract Text

(1) The following provisions regarding the conclusion of the contract apply to orders placed through our online shop https://modeltraincontrol.com.

(2) In the event of a contract being concluded, the contract is made with:

(3) The presentation of goods in our online shop does not constitute a legally binding offer, but rather an non-binding invitation to the consumer to place an order. By placing an order, the consumer makes a binding offer to conclude a purchase contract.

(4) The contract is concluded through the following steps:

  • Selection of desired goods
  • Click on "Add to Cart"
  • Review of the shopping cart
  • Click on "Proceed to Checkout"
  • Entering contact, delivery, and payment information
  • Confirmation by clicking "Pay Now"

The consumer can correct any input errors before submitting the order or cancel the order process. After submitting the order, the customer will receive an automatic email confirming receipt ("Order Confirmation"). This constitutes acceptance of the offer.

(5) Storage of Contract Text:
The order data and these Terms and Conditions will be sent to the customer via email. The Terms and Conditions can also be accessed at any time on the website. For security reasons, order data is no longer accessible via the internet.

§3 Prices, Shipping Costs, Payment, Due Date

(1) All prices stated include the statutory value-added tax. Shipping costs are calculated separately.

(2) The following payment methods are available:

(3) In case of payment by prepayment, the amount must be transferred immediately after the contract is concluded.

§4 Delivery

(1) Unless otherwise stated, delivery will take place within 7 business days after the conclusion of the contract or after receipt of payment (in case of prepayment).

(2) If the delivery date falls on a Saturday, Sunday, or public holiday, it will be postponed to the next business day.

(3) The risk of accidental loss passes to the buyer only upon delivery of the goods.

§5 Retention of Title

The delivered goods remain our property until full payment has been made.

§6 Right of Withdrawal for Consumers

Consumers have a right of withdrawal in accordance with the Withdrawal Instructions.
